Terms of service

Version 2026-09-25-v1 · Effective 25 September 2026

These terms govern SaveState accounts, subscriptions, encrypted backup storage, restores, and related support across savestate.dk and its subdomains. The contract is formed only when the customer actively accepts these terms in the purchase or onboarding flow.

Provider and contact

SaveState, operated personally by Gustav Fyhn Larsen

legal@savestate.dk · support@savestate.dk

If you buy for an organisation, you confirm that you have authority to bind it. Business customers whose backups contain personal data also agree to the Data Processing Addendum.

The service

SaveState provides Windows software and hosted infrastructure for creating, storing, monitoring, and restoring encrypted backups. Eligible plans can also connect the desktop app directly to customer-owned S3-compatible object storage. You remain responsible for selecting the data to protect, keeping working recovery credentials, maintaining suitable local or independent copies, and periodically testing restores.

Accounts and encryption keys

You must provide accurate information, protect account credentials and encryption material, and promptly report suspected unauthorised access. Backup data is encrypted before upload. SaveState account recovery can restore account access but cannot recreate a lost customer-controlled decryption key; losing all valid key material may make backups permanently unrecoverable.

Plans, prices, trial, and renewal

SaveState has three customer-facing tiers: Basic 10 GB, Pro 150 GB, and Enterprise 1 TB of SaveState-managed storage. Basic permits up to 2 enabled scheduled backup profiles, Pro up to 5, and Enterprise up to 20. Manual-only profiles do not count toward this scheduler limit. Each tier is available with monthly or three-month billing at the DKK or USD price displayed on the pricing page and in Stripe Checkout. Denmark defaults to DKK and other countries default to USD; you can change the currency before Checkout. These are separate fixed catalog prices rather than a live exchange-rate conversion. Checkout displays both the amount due for the order and the recurring subscription price, including any trial or promotion. SaveState is not VAT registered and does not currently add VAT. If registration or another tax obligation later changes, any required charge will be shown before the customer places a future order.

A valid affiliate link can apply its associated promotion automatically, and a customer may enter a valid affiliate code on SaveState before Checkout. Before the first positive paid invoice, the latest link replaces an earlier link and a manually entered code takes priority over a link. The first positive paid invoice permanently fixes that customer to one Affiliate, so no payment can credit two Affiliates. Self-referrals and transactions controlled by the Affiliate are prohibited. Fraudulent, test, unpaid, reversed, or disputed transactions do not earn commission. The discount amount, eligible currency, and duration are shown before confirmation. Affiliate arrangements do not increase the customer’s price or give an Affiliate access to customer email addresses, payment credentials, accounts, or backup data. Affiliate participation is governed by the Affiliate Agreement.

Eligible new accounts may receive one 14-day trial on Basic. An account must be created before Checkout, a valid payment method is required, and the trial converts to the selected paid Basic subscription unless cancelled before the trial ends. Accounts that have previously used a SaveState trial are billed immediately. Pro and Enterprise begin billing immediately. Subscriptions renew for the selected monthly or three-month interval until cancelled. Stripe processes payments and may request billing or tax-identification information.

Cancellation and consumer withdrawal

You can cancel through the account dashboard. Cancellation stops future renewals and normally takes effect at the end of the paid period; service continues until then. Except where law requires otherwise, amounts already charged are not refunded merely because you stop using the service.

If you are a consumer, you normally have 14 days from formation of the distance contract to withdraw without giving a reason. Before Checkout, SaveState asks separately whether you expressly request service activation before that period expires. The service will not be activated early without that affirmative request. If you withdraw after requested performance has begun, SaveState may charge only the proportionate amount permitted by mandatory law for the service supplied before notice. The right is not waived merely by accepting these terms.

To withdraw, send an unambiguous statement to billing@savestate.dk before the deadline. You may use: “To SaveState, operated by Gustav Fyhn Larsen, billing@savestate.dk: I hereby give notice that I withdraw from my contract for [service], ordered on [date]. Name: [name]. Address: [address]. Date: [date].” Using that wording is optional.

After ordering, SaveState sends the contract information, the statutory model withdrawal form, and confirmation of the customer’s consents to the account email in a durable form. The final Stripe action is labelled “Buy” (or Stripe’s corresponding local-language label) and is accompanied by an express recurring-payment notice so that placing the order clearly creates a payment obligation.

Expiry, grace, and deletion

Whenever a subscription ends—including cancellation, the end of a trial, or failed payment—normal backup access ends and a three-day restore-only grace period begins for SaveState-managed backups. New backups are blocked during grace. SaveState sends an expiry notice when the service enters grace. At the deadline, managed restore access ends and SaveState permanently deletes the service’s Backblaze bucket, every managed backup-object version, snapshot and folder metadata, and related service-usage state.

Customer-owned storage is separate: SaveState does not delete objects from your provider when the subscription ends. With the desktop app, your provider credentials, and your account decryption key, you may reconnect an existing customer-owned repository for restore even without an eligible active plan. New customer-owned backups and repository creation require an eligible active plan. Your provider may continue to charge for stored objects and may apply its own retention rules; manage or delete those objects through that provider.

Automatic subscription expiry does not delete the global login or encrypted account-key envelope. The envelope remains so the same client-side key can unlock any customer-owned repository later; SaveState cannot decrypt it for you. The customer can sign in and buy a new service later, or request full account erasure through privacy@savestate.dk. Erasure deletes SaveState’s copy of the envelope and may make any remaining customer-owned backup permanently unreadable if no independent key copy exists. Records legally required for accounting, security, or disputes may still be retained.

Storage and data transfer

Basic includes 10 GB, Pro 150 GB, and Enterprise 1 TB of optimized SaveState-managed backup storage. Usage is the actual encrypted Kopia repository footprint after compression and deduplication, including the packs, indexes, metadata, and stored object versions that occupy space in the customer’s managed Backblaze bucket. Customer-owned storage bytes are outside this managed quota. Identical data shared between restore points is normally stored once. The original source data represented by retained restore points and any displayed optimization savings are comparison statistics and do not determine the quota. Deduplication varies by workload, so the amount of source history that fits cannot be promised in advance.

Uploads, restores, and encrypted repository reads for SaveState-managed storage are included at no extra charge, with no routine monthly transfer quota or paid per-GB overage. Acceptable-use and security controls still apply. Expiring or deleting a snapshot may not reduce physical usage until Kopia maintenance safely reclaims unreferenced packs. SaveState provides temporary reclamation headroom and attempts maintenance near the plan limit; new backups may pause if the repository remains full or reaches its internal safety ceiling.

For customer-owned storage, you choose and pay the provider directly, including any storage, request, or transfer charges. SaveState does not supply, control, or promise a region or retention period for that provider. The desktop app keeps its access credentials on your device; SaveState does not receive those credentials or the customer-owned backup objects.

Acceptable use

You may not store unlawful content, distribute malware, infringe third-party rights, probe or access other accounts, bypass quotas or security controls, disrupt the service, or use SaveState in a way that exposes SaveState or its providers to legal or operational harm. We may suspend affected access when reasonably necessary to stop abuse, protect customers, or comply with law.

Availability and changes

No backup system eliminates every risk. SaveState does not promise uninterrupted operation or that every restore will succeed, and customers should maintain a recovery strategy proportionate to their data. Managed encrypted backup objects depend on Backblaze B2; customer-owned objects depend on the selected provider; SaveState’s edge, application, queue, and database functions depend on Cloudflare; and payments depend on Stripe. A provider outage, data-loss event, suspension, or material service change can therefore affect SaveState. Backblaze’s or another provider’s published durability or service objective describes that provider’s infrastructure and is not an independent SaveState guarantee.

SaveState remains responsible for the service decisions and legal obligations that cannot be transferred to a provider. We may change features or these terms. Material changes will be communicated through the website, service, or account email before they take effect where required.

Paid pilots and prerelease features

If an order or invitation expressly identifies the service as a paid pilot, the core subscription, encryption, grace, and deletion terms still apply, but the pilot may contain defects and does not include a service-level agreement unless the order says otherwise. Any pilot-specific scope, support contact, price, and end date must be stated in the written order or invitation. A pilot label does not remove mandatory consumer or data-protection rights.

Liability

To the maximum extent permitted by law, SaveState is not liable for indirect or consequential loss, lost profit, or loss caused by customer configuration, unavailable key material, unlawful content, failure to keep an appropriate recovery strategy, or an event wholly outside SaveState’s reasonable control, including an upstream provider failure. For a business customer, SaveState’s aggregate contractual liability is limited to the subscription fees that customer paid SaveState during the 12 months before the event giving rise to the claim. This limitation does not apply where liability cannot legally be limited, including mandatory consumer rights or liability arising from fraud, wilful misconduct, or gross negligence.

Law and complaints

These terms are governed by Danish law. If you are a consumer, this does not deprive you of mandatory protections in your country of residence. Please contact support@savestate.dk first so we can try to resolve a complaint.

If we cannot resolve an eligible consumer complaint, it may be submitted to Mæglingsteamet for Forbrugerklager, Nævnenes Hus, Toldboden 2, 8800 Viborg, Denmark. Contact: nh@naevneneshus.dk. Eligibility, value thresholds, fees, and procedure are described on the linked official website. The discontinued EU ODR platform is not available.
